Welcome to The Forge. By purchasing a membership, entering the facility, participating in any activity, or using any equipment, you agree to the following Terms & Conditions.

Effective Date: June 15, 2026

1. Membership Agreement

Membership at The Forge is a month-to-month or prepaid membership agreement that grants access to the facility according to the membership plan selected.

Memberships are personal and non-transferable. Sharing access credentials, key fobs, mobile credentials, or allowing unauthorized entry may result in immediate termination of membership without refund.

2. Assumption of Risk

The Forge is a strength and fitness facility. Participation in physical exercise, weightlifting, cardiovascular training, group fitness classes, and use of fitness equipment involves inherent risks, including but not limited to:

Muscle strains and tears
Sprains
Broken bones
Heart attack
Stroke
Illness
Paralysis
Death

Members voluntarily assume all risks associated with participation in activities at The Forge.

Members acknowledge that no exercise program is without risk and agree to participate at their own discretion.

3. Release of Liability

To the fullest extent permitted by law, The Forge, its owners, employees, contractors, instructors, affiliates, landlords, and agents shall not be liable for any injury, illness, death, loss, theft, or damage arising from:

Use of the facility
Use of equipment
Participation in classes
Participation in personal training
Acts of other members
Facility conditions
Equipment malfunction
Negligence of released parties (except where prohibited by law)

Members release and forever discharge The Forge from any claims or causes of action related to participation in gym activities.

4. Medical Clearance

Members represent that they:

Are physically capable of participating in exercise activities.
Have consulted a physician when appropriate.
Will discontinue activity if experiencing pain, dizziness, shortness of breath, or other concerning symptoms.
The Forge is not responsible for determining a member's medical fitness.

5. 24-Hour Access Rules

Members granted 24-hour access agree to:
Use only their own access credentials.
Never allow tailgating or unauthorized entry.
Ensure doors close securely after entry.
Follow all posted rules and signage.

Members under the age of 18 may only access the facility during staffed hours or while accompanied by a parent, legal guardian, or authorized adult approved by The Forge, unless otherwise authorized in writing by management.

Violation of access policies may result in:

Immediate suspension
Revocation of access
Membership termination
Additional fees for damages

6. Facility Conduct

Members agree to:

Treat staff and members respectfully.
Re-rack weights after use.
Wipe down equipment after use.
Wear appropriate athletic attire and footwear.
Use equipment as intended.
Follow staff instructions.

The following are prohibited:

Harassment
Threatening behavior
Excessive profanity
Vandalism
Drug use
Alcohol use
Smoking or vaping inside the facility
Unauthorized personal training or coaching

The Forge reserves the right to terminate memberships for misconduct.

7. MINORS AND AGE REQUIREMENTS

The Forge welcomes youth participation while prioritizing the safety of all members.

Members Ages 10–17

Individuals between the ages of ten (10) and seventeen (17) may use the facility provided that:

A parent or legal guardian has signed all required membership agreements, waivers, and releases.
The minor complies with all gym rules and policies.
The parent or legal guardian accepts full responsibility for the minor's conduct, safety, and use of the facility.

Children Under Age 10

Children under ten (10) years of age are not permitted to independently use exercise equipment, participate in workouts, or access training areas.

However, children under ten (10) may be present in the facility when accompanied by and under the direct supervision of a parent, legal guardian, or authorized adult at all times.

For purposes of this policy, "direct supervision" means the responsible adult remains physically present with the child and maintains continuous visual and supervisory control. Children may not be left unattended anywhere within the facility, including workout areas, locker rooms, hallways, offices, or common areas.

Parents and guardians are solely responsible for the safety, conduct, and supervision of children under their care while on the premises.

Forge reserves the right to require a child to leave the facility if management determines that the child's presence creates a safety concern, disrupts members, or interferes with facility operations.

Parental Responsibility

Parents and legal guardians acknowledge and agree that they assume all risks associated with a minor's presence and participation in the facility and agree to indemnify and hold harmless The Forge from any claims, injuries, damages, or liabilities arising from the actions or presence of a minor under their supervision.

8. Personal Property

Members are solely responsible for personal belongings.

The Forge is not responsible for:

Lost property
Stolen property
Damaged property

Items left unattended may be removed at management's discretion.

9. Surveillance & Security

For the safety of members and protection of property, The Forge may utilize video surveillance throughout the facility.

By entering the facility, members consent to video monitoring and recording.

Surveillance footage remains the property of The Forge.

10. Payments & Billing

Membership fees are due according to the selected membership plan.

Members authorize recurring charges for memberships that renew automatically.

If a payment method is declined:
Access may be suspended.
Outstanding balances remain due.
Additional processing fees may apply.

The Forge reserves the right to modify pricing with appropriate notice.

11. Cancellations

Month-to-month memberships may be canceled with at least 30 days written notice.

Prepaid memberships are non-refundable except where required by law.

Failure to use the facility does not relieve a member of payment obligations.

12. Membership Holds

Membership holds may be granted at management's discretion for:

Medical reasons
Military deployment
Extended travel

Documentation may be required.

13. Equipment Use

Members agree to:

Use equipment safely.
Follow posted instructions.
Ask staff for guidance if unsure.

Damages caused by intentional misuse may be charged to the responsible member.

14. Photography & Media Release

The Forge may occasionally capture photographs or videos within the facility for promotional purposes.

By entering the facility, members grant permission for their image to be used in marketing materials unless written notice is provided requesting exclusion.

15. Emergency Medical Care

In the event of an emergency, The Forge may contact emergency services.

Members are responsible for all medical expenses incurred.

The Forge is not obligated to provide medical treatment beyond reasonable emergency response efforts.

16. Right to Refuse Service

The Forge reserves the right to:

Refuse service
Suspend memberships
Revoke access
Terminate memberships

for violations of these Terms & Conditions or behavior deemed unsafe or disruptive.

17. Indemnification

Members agree to defend, indemnify, and hold harmless The Forge from any claims, damages, liabilities, costs, or legal expenses arising from their use of the facility or violation of these Terms.

18. Governing Law

This Agreement shall be governed by the laws of the State of Utah.

Any legal disputes shall be resolved in the courts located in San Juan County, Utah.

19. Severability

If any provision of these Terms & Conditions is determined unenforceable, the remaining provisions shall remain in full force and effect.

Member Acknowledgment

I acknowledge that I have read, understood, and agree to these Terms & Conditions. I understand that participation in fitness activities involves inherent risks and voluntarily assume those risks.
